Primary Custody
Within the two (2) types of custody–physical and legal–the custody arrangement can be broken down into three (3) variations pursuant to O.C.G.A. § 19-9-3(a)(1):
Primary custody generally refers to primary physical custody–the primary physical custodian being the parent having most of the visitation time with their child during the year (i.e., the parent having 51% percent of visitation or more during the year).
