RESTORATION OF GUN RIGHTS: OVERVIEW
A guilty plea or conviction to certain crimes in the state of Georgia–state offenses or federal offenses–can change your life forever. One of the ways in which your life may change is the loss of your Constitutional Second Amendment right to carry, possess, and transport firearms.
In the state of Georgia, a guilty plea to, or the conviction of, a felony will result in the loss of your right to carry, possess, and transport firearms.
Additionally, under federal law a guilty plea to, or the conviction of, a family violence (domestic violence) misdemeanor in the state of Georgia will result in the loss of your right to carry, possess, and transport firearms.
RESTORATION OF GUN RIGHTS FOR STATE VS. FEDERAL OFFENSE
Under Georgia law–as well as federal law–however, you can have your firearm rights restored if certain conditions are met.
In addition to losing your gun rights due to certain state offenses, you may also lose your gun rights due to certain federal offenses.
Depending on whether your offense was a state crime or a federal crime, the process for restoring your gun rights varies:
In certain situations, you may be denied the ability to purchase a firearm, even though you are unaware of any convictions preventing your purchase. In that instance–a Firearm Purchase Denial–you may challenge the denial through the Federal Bureau of Investigation. This process is known as a Firearm-Related Challenge.
