TYPES OF CUSTODY: PHYSICAL VS. LEGAL
In the state of Georgia, custody rights are divided in to two (2) types:
1. Physical Custody, and
2. Legal Custody.
The easiest way to differentiate between these two (2) types of custody is to remember that physical custody deals with which parent has their child in their physical care for most of the year, while legal custody deals with which parent has the authority to make legal decisions (education, religious upbringing, non-emergency medical, and extracurricular activity decisions) for their child.
TYPES OF CUSTODY: SOLE VS. PRIMARY VS. JOINT
Within each of these two (2) types of custody, the custody arrangement can be broken down into three (3) variations pursuant to O.C.G.A. § 19-9-3(a)(1):
