In the state of Georgia, workers’ compensation is a certain type of insurance provided by employers to employees who have been injured in the scope of their employment. O.C.G.A. § 34-9-1 et seq.
Before workers’ compensation benefits can be received, an employee must be able to show that the injury arose “out of and in the course of the employment.” O.C.G.A. § 34-9-1. Once established, benefits range from the recovery of medical expenses to monetary benefits for missing work and permanent impairment due to the injury. Unless the injury is “catastrophic” as defined by law, benefits are generally limited in time.
