Property Deed
A property deed is a legal document that conveys ownership of real property (land or real estate). Property deeds come in many forms, ranging from Quit Claim Deeds (conveyance of property without a guarantee of clear (or valid) title) and Warranty Deeds (conveyance of property with a guarantee of clear (or valid) title) to Life Estate Deeds (conveying property ownership during a person’s life).
In the state of Georgia, in order for ownership of property to be validly transferred, a property deed must be recorded and notice of the transfer made. Pursuant to O.C.G.A. § 44-2-1, “[e]very deed conveying lands shall be recorded in the office of the clerk of the superior court of the county where the land is located. A deed may be recorded at any time; but a prior unrecorded deed loses its priority over a subsequent recorded deed from the same vendor when the purchaser takes such deed without notice of the existence of the prior deed.”
